Using %fv file tag in a Conditional statement

I can't get the conditional tag in the following to work. I've tried the operand with and without quotes. Can anyone see what I'm doing wrong?  Any help would be greatly appreciated.

#Bitrate
%Vl(a,86,40,40,40,4)
#Green
%Vf(00FF04)
%Fl(4,12-Adobe-Helvetica.fnt)
%?if(%fv, =, "(avg)")<%ac%fbk VBR|%ac%fbk CBR>
%ac%fc

Don't know why that doesn't work but you could just use

%?fv<%ac%fbk VBR|%ac%fbk CBR>

(or it might be the other way round!)
