3.8 ipod 5.5 is now not shuffeling correctly

Hi, Sorry if this is the wrong location for this post I didnt know where else to post this (looks like) new bug.

I just installed 3.8 on my 240gb ipod and it no longer shuffels correctly.  i have 2 cfg files on the root on my ipod which are updated to include all of the 3.8 setting lines, called day setting and night setting.

in my cfg's the shuffle is on by default.
if shuffle is on... a song plays i turn shuffle off it still shuffles
if shuffle is off ... a song plays i turn shuffle on it does not shuffle.
the shuffle seems to not work only after the ipod has cached the upcoming music. So if I load a new batch of songs then it shuffles correctly

So for example the problem is if i have 1000 songs in my 80s folder and they are playing randomly and depeche mode plays and I want to turn shuffle off to keep listening to dm, turning shuffle off has no effect. I have to turn shuffle off exit into my 80s folder select dm and then it will play straight through.
