New Theme Issue

Working on a new theme for the iPod Video and having trouble with placing a conditional viewport over the main menu in .sbs when hold is set... it seems to hang there after unlocked until you touch scroll.. it then disappears and you can see the menu again... is there a work around, is this a bug or is this just the way it works and nothing can be done about it?

Edit: I tried to use a conditionally display %?mh<%Vda|%Vi> but doesn't work also even when locked if I move the selection it brings the menu back... so the info page popup sticks until moved locked or unlocked after being initially locked :\ guess I cant use it on the sbs like that.
