Theme licensing question

I have a H320 theme that I modified from the IpodColor* themes from the old theme site

I made it work with current builds, plus i modified it heavily to make it how i want it, (new font, viewports, bitmap strips, different layout etc.) but the bitmaps are copied from those themes.

Is that something I can post and distribute or do I need permission from the original authors, who are unknown?
I can post a screenshot if anyone is interested, and I would have to do a little work to package it properly but I really like it.

If the user included a license with it, then that applies.

If they didn't, you have to ask them for permission.
