Do i have to put this icon under my themes myself or does someone else judge, if my themes meet the criteria?

That idea never gained the traction I had hoped it would.  (Probably can blame me.)
I think most everyone agrees the guidelines are good ones, we've just been kicking around the "new theme site" excuse for quite some time now.

Maybe take the site off the wiki then? I mean, the guidelines on the soap page are nearly identical to the ones on the Theme guideline page.

Up 'till now, I thought the icon simply meant that soap really likes the theme.

Where are you seeing links / demands to the Seal Of APproval page?
It was the result of some discussion a few of us had a while ago, and I think if you look at the wiki history you'll see the Theme Guidelines were updated to reflect some of the ideas from the S.O.Ap page, not the other way around.
