That license allows you to share and remix the work as long as it's released under a similar license.

I have a partially done (abandoned) H300 port of it if that's of any help.

jswetzen is the author of the original theme for the 5g iPod.  But as MarcGuay indicated it's released under the Creative Commons Attribution-Share Alike 3.0 License.

As everybody has already said, it a SA by CC license (same as Johan Swetzen's original) and you're free to update this. However note that I already updated the theme to use the new %pb tag a week ago
