Some sources of images with an open license.
« on: April 16, 2008, 07:32:52 PM »
Flickr has a whole set of images licensed under CC licenses that are searchable by license.  For instance, you can search pictures that are released under an Attribution Share-Alike license.  There's also a list of public domain pictures there.  Openphoto.net also seems like a good resource for creative-commons licensed images.

NASA photographs may also be fair game.

Photography

Photographs are not protected by copyright unless noted. If copyrighted, permission should be obtained from the copyright owner prior to use. If not copyrighted, photographs may be reproduced and distributed without further permission from NASA. If a recognizable person appears in a photograph, use for commercial purposes may infringe a right of privacy or publicity and permission should be obtained from the recognizable person.

edit:

I split this from the jClix topic since it was kind of off-topic for that discussion.  Discuss other sources of open-licensed images/media here as well as how to organize this info for the wiki.

It would be sad having to waste ALL the old backgrounds, IF some of them could actually be used (i.e. they'd have the proper licensing), but I suppose their license is very hard to locate after almost two years, even if someone really wanted to... anyway Chronon

I think your approach is very constructive and it's nice to see that, so even if the sources you mention end up not being used for jClix, they surely are valuable for new themes, since is not so easy to find quality images that also have the adequate licensing

I agree that it would be a shame to discard any work unnecessarily.

I guess this info should go on the wiki somewhere, though I'm not too sure where at the moment.

I found a few options listed below; maybe the information could be placed in one of them, and then put links to it on the others:

Yeah, I was thinking that the ThemeGuidelines page might be the most logical as it has to do with other rules of submitting themes to the wiki.  I'll give it a go a little later.

edit: I added a blurb toward the end of the ThemeGuidelines page.

Never knew that rockbox was so strict about this kinda things.
i really never look to the copyright before I start spreading them, though I don't have a community like rockbox with 1000s of users.

Why the strictness, never knew that there where ever any problems with copyright images?

The GPL depends on copyright law to be effective. It would be rather hypocritical to say "We want our copyrights respected, but we're not interested in respecting the copyrights of others" wouldn't it?

We expect other people to respect our copyright, and therefore we respect other people's copyright.  The problem with distributing copyrighted images that you do not have a right to do so is illegal.  In order to distribute any themes you need to have a clear licence allowing to use all the contents, be they images, icons, whatever.  If you have any unlicensed themes on the wiki, please remove them, or fix them to be licensed.  Thanks very much!

:S sorry, didn't mean to be rude....
i was just wondering, never knew to find such a clean community. that's a compliment.

i understand what you are trying to say, and it is a very reasonable explenation. and no, I don't have a copyrighted picture uploaded. I actually never uploaded something that was copyrighted. I don't upload torrents, expect downloading them. and downloading is legal, but uploading isn't.

Sorry again if I was rude or made an annoying observation, I did not mean to do so.

According to the US Copyright Office:
"Uploading or downloading works protected by copyright without the authority of the copyright owner is an infringement of the copyright owner's exclusive rights of reproduction and/or distribution."

Specifically downloading is infringing on the right of reproduction. Downloading it is just as illegal as uploading, at least in the US and anywhere with equivalent protective rights. Anyone who told you otherwise was simply spreading a somewhat common, but incorrect, myth.

We respect all copyright here. Unless something has a license saying otherwise, that means it's "All rights reserved."

As far as my research shows, Belgium is a signatory of the Berne Convention, meaning the right of reproduction is one of those that the law must provide protection for.

But this is off-topic for this forum. In regards to copyright, we tend to use the US restrictions for content hosted.

I found another portal to some sites with public domain images.  I guess I will make a page to organize these resources and then link to that from ThemeGuidelines instead.

I will post back with the name of the wiki page so others can add other resources.

I named it FreeImages.

What are the implications of placing a public domain image (no restrictions) in a theme with a restrictive (Creative Commons) license?
I assume at a minimum you must license the images separately than the remainder of the theme?
