Soap, what would be needed in this specific case for this to be OK?

The best thing would be for the original author to release the theme with an explicit license.

well the buttons displayed and the glass-like center seem to be ideas taken from the iriver, but the background images in the jClix themes for ipod are not osx taken as far as I know
