The issue here is that you cannot access/share/do whatever else with the roms.  Contrary to popular belief, it IS illegal to download the rom for a game that you already own...you must make it yourself.

Emulating any given piece of hardware is legal.  And it's legal for you to extract a ROM (or make a copy of said ROM) for a game that you own.  But I have not seen any decent justification that distributing copyrighted ROMs is legal.

That would be because there is none. If someone wants to pirate a whole ton of ROMs, we DON'T want to know about it, and we're NOT going along for the ride if they get busted for it.

I don't know, I've seen some pretty convincing legal information on romsites before.  Stuff like:

Also, and additionally, You might take note of the fact that ifd you download this, it is LEGL to keep it up to and including for 24 (or 48 or 76) hours (depending on where you live in) for DEmonstrating PURPOSES ONLY!! After that, you nmust delete it off of from your computer before the FBI track your computer.

And US law doesn't really apply to the rockbox forums as far as I can tell ... so that wouldn't really matter. I guess that people hosting the forums just want to stay on the safe side even if it is legal to cite a game's name (IMO).

Although the rockbox site is hosted in Sweden, the forums are in the US.

However, this is all slightly academic - aside from any legal problems, we respect other people's copyright, and that includes not facilitating downloading ROMs.

You probably don't want to be basing an evaluation of legality on the writings of someone who doesn't know how to spell "illegal."

Well, I'm pretty sure that post with the quote was intended as humor rather than a serious statement.

But in the end, it doesn't matter whether it's legal or not in any given country: The forum rules state not to link to ROM sites, as from our opinion, not legal but personal, it is wrong to distribute a material copyrighted by someone else without their explicit permission. Whether illegal or not, those are the rules here, plain and simple.
