Looks like rockbox infected the ability of the ipod to detect the battery charge state
The battery worked just fine before installing rockbox and even after installing it showed 100% on rockbox menu in few occasions only when I select a menu item the ipod shuts down, it's a no brainer a bug got introduced to the ipod battery management software,
